South Dakota Bill Will Make Killing of Abortion Providers "Justifiable Homicide"
/I implore all the people reading this older article about South Dakota abortion restrictions — and the new ones in today’s article on South Dakota House Bill 1237 — sign our ERA petition at once. I explain fully in today’s article and last week’s Only ERA Can Protect American Women Against Right-Wing, Anti-Contraception Agenda | Sign Our Petition that four justices are poised to send Griswold v Connecticut back to the states, stripping away women’s right to birth control. Justice Scalia explains that American women have no rights under the Constitution, except the right to vote from the 19th amendment. Scalia says women have no right to privacy and no rights under the 14th amendment. For goodness sake, please take this viscious new assault on American women seriously. If Romney had won the election, every right that American women have won in the last 50 years would be sent back to the states.
Update 2/1/2013: This 2011 bill was pulled after the uproar it caused nationally and pushback from people like myself. The article is getting many reads again, after I wrote Gang of 10 Republican NY Women Want To Jail Rape (and Incest) Victims for 3 Years If They Abort. Today’s new article focuses on SD’s current drive to further restrict women’s rights in the state by eliminating holidays as part of the 72-hour waiting period.
This particular bill is dead for now, but the intention to criminalize abortion and then contraception is not. American women in about half our states are in for a heck of a ride in the next few years as ALL our rights are stripped by Republicans in state legislatures.
Any American who is wondering if American women are under assault by Republican men has an answer. We will submit, or they will kill us. Anne was stalked for a year by a man who was intent on killing her after Roe vs Wade became law, so we know they mean business.
The Republican-led South Dakota legislature has passed out of committee House Bill 1171, expanding the definition of “justifiable homicide”, making it legal to kill doctors who perform abortions.
The language of the bill suggests it reaches beyond abortion doctors. We are trying to understand the scope of the bill, but it certainly reads like it puts all Planned Parenthood counselors at risk of being murdered. We’re not being smart here. Does this bill legalize honor killings in America? Can a father justifiably kill his daughter for having a legal abortion?
The bill, sponsored by state Rep. Phil Jensen, a committed foe of abortion rights, alters the state’s legal definition of justifiable homicide by adding language stating that a homicide is permissible if committed by a person “while resisting an attempt to harm” that person’s unborn child or the unborn child of that person’s spouse, partner, parent, or child. If the bill passes, it could in theory allow a woman’s father, mother, son, daughter, or husband to kill anyone who tried to provide that woman an abortion—even if she wanted one. via Huffington Post
South Dakota already has a law that allows people who commit crimes that result in the death of unborn fetuses to be charged with manslaughter. Jensen’s bill —HB-1171 — would incorporate similar language to the definition of “justifiable homicide”
